Discrimination can take various forms and can include age, sex, race, sexual orientation, religious and disability.


For the purpose of employment disputes there are three types of discrimination which are direct discrimination, indirect discrimination and victimisation.


Direct discrimination is where a person is subjected to less favourable treatment in comparison with other employee’s. Indirect discrimination is where a requirement, condition, provision, criterion or practice disadvantages the worker and victimisation is where a worker is punished for complaining about discrimination.


The area of discrimination is complex and it is important to gather as much evidence as possible to support any claim. Initially, a questionnaire should be sent to the employer asking various questions to obtain additional evidence. Ideally this questionnaire should be sent before commencing any proceedings in the Tribunal.
